Office of the Auditor General (OAG) – Jubbaland State Somalia

Jubbaland Audit Bill – English Version

The State Audit Act 2016 establishes the legal framework for public sector auditing in the Jubaland State of Somalia, with the primary objective of strengthening accountability, transparency, and oversight in the management of public resources.

The Act provides for the establishment of the Office of the Auditor General as an independent public institution, mandated to audit all public bodies, government entities, and any organisation managing public funds. It ensures that the Auditor General operates with full independence, free from external direction or control, while being accountable to the State Assembly.

The legislation defines the appointment, qualifications, tenure, and removal procedures of the Auditor General, reinforcing the integrity and impartiality of the office. It further outlines the organisational structure of the audit institution, including provisions for staffing, governance, and the use of contracted expertise where necessary to support audit functions.

The Act grants the Auditor General extensive powers to conduct financial, compliance, and performance audits across all public institutions. It provides unrestricted access to information, documents, systems, and personnel required to carry out audits effectively. It also establishes mechanisms for investigating fraud, reporting irregularities, and referring cases for prosecution where necessary.

A structured audit and reporting framework is defined, requiring the preparation of annual and special reports to be submitted to the State Assembly and made publicly available. The Public Accounts Committee is mandated to review these reports, hold institutions accountable, and ensure the implementation of audit recommendations.

The Act also addresses the financial independence and operational sustainability of the Office of the Auditor General, including provisions for funding, budget approval, and cost recovery mechanisms. At the same time, it introduces accountability measures for the audit office itself, including independent audits of its operations and regular reporting obligations.

Finally, the legislation establishes offences and penalties related to obstruction of audit processes, misuse of information, and misconduct by both public officials and audit personnel. It also provides legal protections for the Auditor General and staff in the execution of their duties.

Overall, the State Audit Act serves as a critical instrument for enhancing public financial management, promoting good governance, and ensuring that public funds are used efficiently, effectively, and in accordance with the law.
